Frequently asked questions

Questions about homeowners' associations

How long do I have to challenge a resolution of the general meeting?

Three months from the meeting, or from when you were notified if you didn't attend. If the resolution breaches the law or the bylaws, the deadline is one year.

Can I challenge a resolution if I owe fees to the association?

Only if you pay up or deposit what you owe. The exception is resolutions that set or change the ownership shares.

How do you claim from an owner who doesn't pay?

With a debt certificate approved at the meeting, the association can use the payment order procedure, which is quick and needs no trial if the debtor doesn't object.
